Privacy Policy

Your privacy is important to PayGround, Inc. (“PayGround”, “we”, “us”). This Privacy Policy (“Policy”) explains how PayGround collects, uses, and discloses information through its websites, platform, mobile applications and other online services that link to this Privacy Policy (collectively, the “Services”) or otherwise interact with us. If you obtain your use of the Services in connection with the services offered by a third party, the individual terms of that third party’s contract with PayGround and its own privacy policy may differ from what is described in this Policy. This Policy does not apply to information collected through other means, such as in person or over the telephone. Also, if you are a patient of a PayGround contracted healthcare provider (“Provider”), consult the HIPAA Notices of Privacy Practices of your Provider to understand how such practices also apply to your protected health information (“PHI”). This Policy also does not apply to information we collect about employees, job applicants, or independent contractors.

Changes to This Policy

We may change this Policy from time to time. If we make any changes to this Policy, we will change the “last updated” date above. If there are material changes to this Policy and you have an active account with us, we will notify you more directly (for example, by email or by posting a notice within the Services). We encourage you to check this Policy whenever you use any of the Services to understand how your personal information is used.

State Privacy Disclosures

If you are a resident of certain U.S. states, additional disclosures and rights may apply. Please review the “Information for Residents of Other States” section below for more information. If you are a California resident, please review the “Information for California Residents” section below and our California Privacy Rights Notice, available here. If there is a conflict between this Policy and applicable state law, state law will control to the extent of the conflict for residents of that state.

Information Collected

We collect information from you in various ways when you use our Services. We may also supplement this information with information from third parties. We collect two general types of information, namely personal information and aggregate data. As used in this Policy, the term “personal information” means information that specifically identifies an individual (such as a name and email address) and demographic and other information when directly linked to information that can identify an individual.Our definition of personal information does not include “aggregate data.” Aggregate data is information we collect about a group or category of services or users from which individual user identities have been removed. In other words, the aggregate data has been de-identified so that no personal information is included in aggregate data. Aggregate data helps us understand trends in our users’ needs so that we can better consider new features or otherwise tailor our Services. We only de-identify and aggregate your PHI with your written authorization.

Information You Give Us or That You Authorize Others to Give to Us

We collect information you give us through our Services and when you register for and use our Services, and information that you authorize others to give to us. Examples include the following:

  • Registration and Profile Information. When you register to use our Services or update your profile, we may collect various kinds of information about you including: your name and email address, telephone number, date of birth, Provider name, and other profile information you provide or that you have others provide to us; demographic information; and information you upload such as files and documents.
  • Payment Information. We do not maintain your credit card information and transmit such credit card information via tokenization for security purposes to our payment processing vendors. We may, however, receive limited information about your payment transaction (such as confirmation that a payment was made, the payment amount, date/time, and a truncated payment instrument identifier) from our payment processors.
  • Submissions and PayGround Service. From time to time, we may request information from you, such as when you respond to surveys, provide feedback, participate in promotions, or contact customer support. The information you provide may include personal information, demographic information, and the contents of your communications.

Automatically Collected Information

We automatically receive certain types of information when you interact with our Services. For example, it is standard for your web browser to automatically send information to every web site you visit, including ours. That information includes your computer’s IP address, access times, your browser type and language, and referring web site addresses. We may also collect information about the type of operating system you use, your account activity, and files and pages accessed or used by you. We may collect some of this information using pixels, SDKs, log files, and similar technologies.

Cookies and Web Beacons

We may also use certain kinds of technology such as cookies and web beacons to collect information. Among other things, the use of cookies and web beacons enables us to improve our Services and emails by seeing which areas and features are most popular, to count the number of computers accessing our web site, to personalize and improve your experience, to record your preferences, and to allow you to visit our Services without re-entering your member ID and/or password. A cookie is a small amount of data that is sent to your browser from a web site’s computers and stored on your computer’s hard drive. Most browsers automatically accept cookies as the default setting. You can modify your browser setting to reject our cookies or to prompt you before accepting a cookie by editing your browser options. However, if a browser is set not to accept cookies or if a user rejects a cookie, some portions of the web site and services may not function properly. For example, you may not be able to sign in and access certain web page features or services. A web beacon is an electronic image, also called a “gif,” that may be used on our web pages to deliver cookies, count visits, and compile statistics on usage and campaign effectiveness or in our emails to tell if an email has been opened and acted upon.

We may also allow third-party analytics providers to use cookies, web beacons, or similar technologies to help us understand usage of the Services and improve performance. To the extent these third parties collect information through these technologies, their collection and use of information is subject to their own privacy policies. We do not control these third parties’ privacy practices, and you should review their privacy policies for more information.

Use of Personal Information

In general, we may use personal information for the following purposes:

  • Provide and operate the Services. To create and administer your account and provide platform functionality.
  • Communicate with you. To respond to your inquiries, send service-related messages (such as confirmations, receipts, technical notices, updates, security alerts, and administrative messages), and provide customer support.
  • Improve and develop the Services. To monitor and analyze usage, troubleshoot, test, research, and develop new features and functionality, including by requesting feedback through surveys or other communications.
  • Personalize your experience. To remember your preferences and tailor content and features within the Services.
  • Marketing and promotions (where permitted). To send newsletters or other promotional communications about PayGround products, services, events, or offers, subject to applicable law and your choices (for example, you may opt out of marketing emails).
  • Security, fraud prevention, and protection of rights. To detect, prevent, investigate, and respond to fraud, abuse, security incidents, and other harmful or unlawful activity; to enforce our Terms; and to protect PayGround, our users, Providers, and others. 
  • Legal and compliance. To comply with applicable laws and regulations, respond to lawful requests, and maintain appropriate records for business and legal purposes.

For other purposes we describe to you at the time of collection or otherwise with your consent where required by law.

Sharing of Personal Information

PayGround may share de-identified and/or aggregated information (information that does not reasonably identify you) about our customers, sales, and traffic with our partners and advertisers to the extent permitted by law, including for analytics, research, improving the Services, and marketing. We may disclose personal information to a third party for the following purposes:

  • To provide the Services to you, including by providing personal information to any third parties (such as payment processing providers, cloud services providers, fraud prevention and identity verification providers, customer support providers, and analytics providers) who we may partner with to provide the Services;
  • To comply with laws or respond to lawful requests and legal process, including national security requirements;
  • To protect PayGround, agents, customers, and others, including to enforce our agreements, policies, and terms of use;
  • In the good faith belief that disclosure is needed to respond to an emergency or protect the personal safety of any person;
  • In connection with an acquisition, merger, or sale of all or a substantial portion of our business with or to another company. In such an event, you will receive notice if your data is transferred and becomes subject to a materially different privacy policy.

This Policy does not restrict our collection, use, or sharing of de-identified and/or aggregated information to the extent permitted by law. We may use and share such information for purposes such as analytics, research, improving the Services, developing new features, and marketing.

HIPAA and Protected Health Information

If we receive your PHI from one of your Providers in connection with our Services, your PHI is protected by the Health Insurance Portability and Accountability Act of 1996, as amended (“HIPAA”) and its implementing regulations (collectively, the “HIPAA Regulations”). Your PHI is also subject to the HIPAA Notices of Privacy Practices of your Providers in addition to this Privacy Policy. Except to the extent otherwise required under law, we will obtain your written authorization before using or disclosing your PHI.

Network and Information Security

We take reasonable steps to protect information we collect from you to prevent loss, misuse, and unauthorized access, disclosure, alteration, and destruction.

The servers on which information is stored are kept in a controlled environment with limited access. While we take reasonable efforts to guard personal information we knowingly collect directly from you, no security system is impenetrable. In addition, we cannot guarantee that any collected personal information you choose to include in documents you store on our systems are maintained at adequate levels of protection to meet specific needs or obligations you may have relating to that information. Nevertheless, we take reasonable measures designed to protect your information. We will notify you of a breach of your personal information when required by applicable law.

Data Retention

We store the information we collect about you for as long as is necessary for the purpose(s) for which we originally collected it and in compliance with applicable laws such as HIPAA. We may retain certain information for legitimate business purposes or as required by law.

Updating and Accessing Personal Information

If your personal information changes in any way, you must correct or update your information as soon as possible. You can make updates to your profile information by logging into your account on the Service at any time. You can also request changes or access to your information by emailing privacyconcerns@payground.com. Please note that we may need to verify your identity before processing certain requests, and we may deny requests as permitted by applicable law.

Choice/Opt-Out

We may send you communications or data regarding our Services, including but not limited to (i) notices about your use of our Services, including any notices concerning data breach or violations of use, (ii) updates, and (iii) promotional information and materials regarding our Services. You may opt-out of receiving promotional emails from us by following the opt-out instructions provided in those emails. You may also opt-out of receiving promotional emails and other promotional communications from us at any time by emailing privacyconcerns@payground.com  with your specific request. Opt-out requests will not apply to transactional service messages such as security alerts and notices about your current account and Services.

Information for California Residents

If you are a California resident, you may have certain rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (the “CCPA”), including the right to request access to, correction of, or deletion of your personal information, and to opt out of the sale or sharing of your personal information (if applicable). You may also have the right to limit the use and disclosure of sensitive personal information (if applicable) and the right not to be discriminated against for exercising your rights. PayGround does not respond to Do Not Track (DNT) signals.  Some third parties may track your actions when you are browsing and accessing content.  Various browsers offer a DNT option that sends a signal to third parties that you do not want to be tracked.  California Civil Code Section § 1798.83 (“Shine the Light” law) permits users of our Services that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Information for Residents of Other States

Residents of other certain U.S. states may have additional rights regarding their personal information, including the right to opt out of certain processing of personal information (such as targeted advertising and sales of personal information, as defined by applicable law) and to submit requests to access, delete, or correct personal information, subject to exceptions.
